Job Description Summary: Under the general supervision of the Liquor Control Commission who are appointed by the Mayor and confirmed by the County Council, this Position is responsible for the administration of the office of the Department of Liquor Control of the County of Kauai. The Commission’s jurisdiction, function and powers are prescribed in Section 281-17, Hawaii Revised Statues and Article XVI of the Kauai County Charter.

  • Responsible over all Liquor Control Commission activities: promulgates and administers the liquor laws as required by Chapter 281, Hawaii Revised Statues, Administrative Procedures Act, and the Rules of the Liquor Control Commission.

  • Plans, develops, and administers all policies, procedures and rules for the following:

    Application of the issuance of Liquor licenses to business establishment.

    Consumption of liquor by minors and minor’s employment in liquor establishments.

    Collection and receipt of monies due the County by licensees, applicants and individuals for the payment of liquor license fees, filing fees, other miscellaneous fee s, permits, fines, and refunds to applicants when licenses are issued.

    Enforcing State Liquor laws and rules of the Commission when licensees are found in violation or non-compliance with such laws and rules in the operation of their business. Issue citations, notifications, subpoenas and the findings and decisions on behalf of the Commission.

  • On a continuing basis, reviews, analyzes and revises existing policies and procedures to provide more effective and efficient licensing programs.

  • Drafts, and recommends changes and revisions to the Liquor Laws of Hawaii, prepares position papers, renders written and oral testimony for/or against legislative proposals before the Legislature and Liquor Commission.

  • Collaborates with the Mayor and their Administration to effectively administer and enforce the Liquor laws of the State of Haw ii and the County of Kauai.

  • Maintains liaison with County, State and Federal agencies i.e. State Department of Taxation (DOTAX)Internal Revenue Service, U.S. Customs, U.S. Citizens and Immigration Services (USCIS), Kauai Police Department, Alcohol, Tobacco, and Firearms Tax Bureau (STTB), Federal Bureau of Investigation, and military organizations on matters of mutual concern.

  • Confers and consults with law enforcement agencies and initiates program planning and improvement of activities.

  • Maintains liaison with representatives of the liquor industry wholesalers, manufacturers, Retail Dealers Association, Restaurant Association, and Hotel Association to discuss and solve mutual problems to develop and improve procedures in the overall furnishing of alcoholic beverages to the public.

  • Confers with all county liquor officials within the State of Hawaii regarding statutory changes relating to liquor licensing laws affecting operations and provides materials and guidelines for implementing such changes with the aim of establishing consistency and uniformity in enforcing law s and rules on a statewide basis.

  • Directs the development of work programs, schedules and determines priorities and deadlines, determines proper execution and application of liquor law s and rules, signs all vouchers, payroll reports, correspondence and other reports for the Liquor Control Commission.

  • Receives and reviews all incoming letters, reports, applications and other matters directed to the Commission, assigns all necessary issues to proper staff members for processing and/or to the Commission for action.

  • Prepares and issues circulars and bulletins for the Liquor Control Commission.

  • Advises licensees, licensee’s employees, license applicant s, other Departments of Liquor Control in the State of Hawaii, and the general public on Commission actions, policies, and rules. Arranges for press releases as necessary.

  • Develops and administers the Commission's Strategic Plan to assure progression of the goals and activities of the Commission.

  • Evaluates operations and application of program policies and procedures.

 

Supervision:

  • Directs, coordinates, supervises and plans the operations and activities of the following branches of the Liquor Control Department: Administrative Services Branch Field Services Branch

  • Counsels, develops, maintains morale and discipline, standards of performance and guides subordinate personnel on day to day activities, operations, personnel appointments, promotions, demotions, disciplinary actions and standards of performance.

  • Reviews recommendations and renders decisions for approval, disapproval, or concurrence in any matter concerning the Liquor Control Commission.

  • Reviews and analyzes all investigative reports submitted to the Commission by investigators and auditors.

  • Directs the execution of the Commission's directives, orders and decisions.

 

Liquor Commission Meeting:

  • Prepares a detailed agenda for each Commission meeting. Must read all material received from staff members, licensees, and the general public for the Commission’s consideration. Prepares comments and recommendations as necessary or desirable for the Commissions.

  • Attends all meetings of the Commission, advises Commissioners on points of law including its legal responsibilities and authority. Ensures that the record of such meetings are completed and accurate, including the directions, orders, decisions, rules and policies. Reviews and corrects minutes of each meeting prepared by the hearing s reporter, and ensures that entries of the Commission's actions into proper files are accurate.

  • Sets dates for public hearings on license applications, ensuring that adequate notice of such hearings is given to the public, the applicant and/or licensees concerned, as required by law.

  • Examines for accuracy that all procedural requirements have been complied with and signs all licenses and permits authorized for issuance by the Commission.

  • Directs the execution of Commission directives, orders, decisions and subpoenas.

 

Other Matters:

  • Prepares quarterly reports listing accomplishments for the quarter and activities to be accomplished within the next quarter.

  • Prepares, reviews, plans and coordinates annual report of the department for submission to the County.

  • Prepares, reviews and approves operational and administrative budget for the Liquor Control Department.

  • Develops a knowledge of the liquor industry and trade problems and practices through contact with the licensees and others in the trade and in liquor law enforcement.

  • Plans and coordinates the conduct of special studies.

  • Conducts trainings and education al classes for licensees, students, community groups and other law enforcement agencies.

  • Performs other duties as assigned.

 

Additional Information: Candidates must possess a minimum of five (5) years of business experience, at least three (3) of which have been in a responsible administrative capacity.

Preferred Qualifications: Bachelor's or Master's degree in Public Administration or Business Administration.

License Requirement: Possession of a valid State of Hawaii motor vehicle operator license (Hawaii Type 3 or equivalent).
